Questions

About this tool

What is a POS-010 proof of service?

POS-010 is the California Judicial Council form called Proof of Service of Summons. The person who delivered the summons and complaint completes it to show the court how, when and where the papers were served.

Who can serve papers and sign the proof of service?

In general, anyone who is at least 18 years old and not a party to the case can serve a summons. The person who actually served the papers signs the proof of service under penalty of perjury, so a party to the case cannot sign it for service they did not perform.

Does this tool file the form with the court?

No. It fills in the official form so you can download, print and sign it. You then file it with the court according to your case's rules and deadlines. We can also file it for you.

Is the information I enter saved or sent anywhere?

No. The form is filled in directly in your web browser and nothing you type is sent to or stored on our servers. If you choose to remember your process server details, they are saved only in your own browser on your own device.

Which form do I use to prove service of documents other than a summons?

POS-010 is for service of a summons. Other documents in a pending case are generally proved with a different Judicial Council form, such as POS-040, so check the court's instructions for your document type.

Form: Judicial Council of California POS-010 [Rev. January 1, 2007]. Court forms are published by the California Courts. This tool is provided for convenience and is not legal advice.
